The following provisions establish the general conditions of sale of the products offered for sale on the site https://www.akhawat.fr by SAS DMK company.

Article 1 - Purpose

These terms and conditions are intended to define the terms of sale between DMK, and any non-commercial and only major individual (hereinafter "Customer") making a purchase on the Site.

Article 2 - Products

The products offered for sale by DMK (hereinafter 'the products') are those listed on the Website on the day of its consultation by the Client.

We have made every effort to display, as accurately as possible, the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate. Descriptions of the products and measurements mentioned on each product sheet, as well as their photos, being given as indications, if errors were introduced there, DMK cannot be held responsible. DMK undertakes to make its best efforts to promptly correct errors or omissions after having been informed. 

Article 3 - Price

Product prices are those appearing on the site the day of consultation by the Client indicated in Euros and include VAT excluding shipping costs which remain the responsibility of the customer except particulars or special conditions.

Article 4 - Order

4.1 Placing order

The Customer materializes his order by completing the following six steps :

Step 1 : The Customer adds the selected products in the cart. Access to the cart is possible at any time to modify or validate,

Step 2 : The Customer checks the details of his cart, consults its total and validate ( All orders implies acceptance by the customer of the prices and descriptions of products which have been placed in the cart),

Step 3 : The Customer enters its full contact details or login to his account,

Step 4 : The Customer is informed of the shipping fees and chooses the mode of delivery,

Step 5 : When validating the order, the Customer expressly accepts the terms and conditions,

Step 6 : The Customer chooses its method of payment then, if necessary, is redirected to the secured payment website to enter the bank account details.

Order is completed when full payment is received.

Placing the order by the Customer implies full and unreserved acceptance of the latter to these terms of sale.

4.2 Order Confirmation

DMK will immediately confirm the order by sending a confirmation mail to the e-mail address that the Client communicated when entering full contact details at the time of his order.

The customer will receive an e-mail confirming :

  • Registration of the order,
  • Details of the items ordered,
  • And personal data including the delivery address.

4.3 Archiving the Order

The Customer agrees that the order confirmation is considered proof of the contractual relationship between the Parties.

Article 5 - Conditions of payment

5.1 Payment by credit card

The payment is made online by credit card at the time of the order. The accepted cards are Visa, Mastercard, Maestro.

The bank account corresponding to the card used for payment will be debited immediately from the time of the order.

5.2 Secure payments

All purchases made by credit card on the Site are protected and secure.

By clicking on the credit card of his choice, the Client is directed to the PAYLINE secure payment web site that incorporates the standard of SSL security. During the payment, the customer indicates his card number, its expiry date and the security code on the back of his credit card.

These data are automatically transmitted in encrypted mode (SSL protocol) to be verified in order to avoid abuse and fraud.

DMK have no access to the Customer's banking data.

5.3 Payment via Paypal

This solution helps protect information that clients communicate to DMK and ensures compliance and security of each transaction.

5.4 Fight against fraud

DMK reserves the right to verify the personal data given by the customer and to adopt all measures necessary to verify that the person whose bank account is debited is the person who placed the order, in order to avoid any fraudulent payment. This verification may take the form of a request for proof of identity and/or home banking documents (RIB or cancelled cheque). The absence of the client's response to a request of this type within 2 days following the request by DMK will automatically result in the cancellation of the order concerned, and this without any possibility of subsequent claims.

This solution helps to protect information that the customer communicates to DMK and ensures compliance and security of each transaction. DMK will also have the freedom to make direct cancellation of an order that would present one or more risk factors for fraudulent use of credit card.

Article 6 - Delivery

6.1 Delivery desination

DMK ship worldwide.

The ordered products will be sent to the address indicated by the Customer during the ordering process. The delivery address cannot be changed after the order is finalised. It is therefore up to them to verify all information before confirming payment.

6.2 Delivery period

DMK process orders from Monday to Friday (except holidays), within 24-48 hours.

Must be added the delivery period depending on the destination and the mean of delivery.

6.3 Shipping fees

Shipping cost do not include any customs fees on arrival.

Shipping fees are charged to the Customer in addition to the price of products, except for special conditions.

The customer must inquire about the customs formalities of his country and the different taxes that customs could apply. Customs taxes are the reponsability of the customer.

6.4 : Loss and damage

DMK offers its customers various modes of deliveries at varied prices. 

The customer freely chooses the carrier from among those offered. The customer must refuse delivery if the parcel or the goods is damaged. Once accepted, it is no longer possible to make a claim. 

In the event of a problem, the customer will make any reservations corresponding to the observations noted on the payment sheet, will have the deliveryman co-sign and will keep a copy of the document.

In the event of damage to transport, the customer must refuse the damaged product to the delivery person and indicate "Refusal for damage" on the payment sheet, failing which any recourse against the latter would be impossible.

By signing the delivery receipt without specific reservations, and acceptance of the products, the customer acknowledges having received the goods in a state giving him any satisfaction

Therefore, any claim related to the condition of the delivered products cannot be received.

DMK offers its customers different delivery methods at different prices. Compensation for loss or damage is more or less important depending on the carrier. The only amount of the refund to which the customer can claim, will be at least equal to the refund made by the carrier that the customer has selected.

For any complaint , please contact us through our "contact" page. All claims regarding defective or missing goods must be notified to DMK withing 48 hours, beyond this time the order will be considered as accepted by the customer and conform the order.

Article 7 - Right of withdrawal

7.1 The Customer has a 14 days period from the date of receipt of the order to convey DMK its willingness to return one or more items without having to give reasons or pay penalties, excepting the shipping costs (this period includes the legal withdrawal period of seven days provided for in Article L.121 -20 of the Consumer Code).

7.2 The Customer must return items to the following address :

In order to facilitate the return request, the customer must join its delivery form which was joined in the parcel he received.

A return request must be made via the customer's account, no return can be made without DMK's approval.

Refund will be made within 30 days through the means of payment used when ordering.

All the delivery costs are in charge of the customer and cannot be reimbursed.

7.3 The Client may have benefited of a conditional promotional offer, allowing him to obtain a discount on the basis of the volume of purchased items (example: reduced or free shipping, decreasing prices for the purchase of multiple items).

- In the case of a return by the customer of a part only of the items having enabled him to benefit to a discount or free shipping, the customer will be liable to DMK for a sum equal to the amount of charges which would be have been charged if the promotional thresholds had not been reached.
- Similarly, the Client may receive a gift for the purchase of one or more products. If the customer returns the product (or a portion of these products), the customer must also return to DMK the gift received. Otherwise the gift will be charged to him.

7.4 Products returned must be new and with their label, unused, unworn and in their original individual packaging...

Upon receipt of the package, DMK observe perfect condition or the returned Products. In case of non-conform return request, time off, without label, products in poor condition (visibly damaged or used by the customer, stained, smelly, with hair, making it unfit for Sale), Products will then be returned to the Customer's expense without any right for compensation or reimbursement, otherwise they will be destroyed...

Article 8 - Personal data

Personal data is required for processing, delivery orders and preparing invoices, collecting this data in the context of distance selling is required. These datas are strictly confidential and are intended solely for DMK under strict management control of the Customer or for a possible event operation.

In accordance with the law n° 78-17 of 6 January 1978 amended by the Act of 6 August 2004, the Customer has a right of access, modification, rectification and deletion of his data.

To exercise this right, the customer must make a request via our contact page or by mail.

Article 9 - Force Majeure

DMK is not liable for the nonexecution or part of its obligations in respect of the order placed by the customer, if this failure is caused by an event constituting a case of force majeure.
In such a case, DMK will inform the customer of the occurrence of such an event within a period of 3 days after its occurrence, by e-mail.
After a period of 1 month, and assuming or the constituting event of force majeure persists, the command will be cancelled and will, if necessary, subject to a refund of DMK under 30 days via the means of payment used at the time of the order.
Article 10 - Intellectual property rights

All elements of the Site, whether Visual or audio, including the underlying technology, are the exclusive property of DMK and enjoy both the protection of the copyright protection afforded by the provisions relating to the right brands.

The total or partial reproduction of one any of these elements, on any medium whatsoever and for any reason whatsoever, without the prior agreement and express DMK is strictly prohibited.

Article 11 - Limitation of Liability

DMK therefore can not under any circumstances be liable for any direct or indirect damage resulting from misuse or incidents related to the use of computer, Internet access , maintenance or malfunction of servers, telephone line or any other technical connection , the connection to the site by Client under its own responsibility.

Article 12 - Modification des Conditions Générales de Vente

The present general conditions of sale are applicable as long as they appear on the Site.

DMK reserves the right to modify them at any time. New terms and conditions will apply only to orders placed after the modification.

Article 13 - Applicable law

The General Conditions of sale being the french language, the parties agree that the contract is subject to french law.

Any dispute which may arise between the Parties due to the formation of the interpretation, execution or termination hereof will report, failing settlement, the exclusive jurisdiction of the courts of TOULOUSE (France).
